Many creators think that YouTube copyright law means, putting a disclaimer in the video, saying fair use or linking to the original video. Creators think this avoids/protects from law suits.
This is not the case. The original creator or owner of the intellectual property can always sue you, despite the video being approved by YouTube.
True fair use will always be determined by a judge, so all these steps do not protect you against a lawsuit.
What protects you, is making sure you do not hurt the original video in its ability to have value or create future value. This means making sure your video does not replace the original or does not reduce the need, for watching the original.
